DarbSafi Terms & Conditions

These Terms & Conditions (the “Terms”) govern your access to and use of the DarbSafi / درب صافي mobile application, website, account services, support channels, legal pages, and related features (collectively, the “Service”).

DarbSafi is a driver productivity and earnings-tracking application. DarbSafi helps drivers record shifts, trips, income, expenses, vehicle-related costs, and estimated net earnings. DarbSafi is not a ride-hailing platform, does not provide transportation services, does not connect riders with drivers, and is not affiliated with Uber, Careem, Bolt, Jeeny, or any other ride-hailing, taxi, courier, or delivery platform unless expressly stated.

By creating an account, checking an acceptance box, accessing the Service, or using DarbSafi, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree to these Terms, you must not access or use the Service.

If DarbSafi is later operated by a registered company or other legal entity, this section may be updated to reflect the official entity name and contact details.

2. Contractual Relationship

These Terms establish a contractual relationship between you and DarbSafi regarding your access to and use of the Service.

Additional terms, feature-specific rules, store rules, or written instructions may apply to certain features, promotions, beta features, paid plans, support processes, or platform-specific versions of the Service. If supplemental terms apply, they will be disclosed in connection with the relevant feature or service. Supplemental terms form part of these Terms for the relevant feature and may control if there is a conflict with these Terms.

We may update these Terms from time to time as described in Section 22.

3. Eligibility

To use DarbSafi, you must:

Be at least 18 years old.
Have legal capacity to enter into a binding agreement.
Use the Service only for lawful purposes.
Provide accurate, complete, and up-to-date registration and profile information.

You represent and warrant that your date of birth, identity-related details, and other account information are accurate and that you are legally able to use the Service.

4. Account Registration and Security

To use some or most features, you may need to create and maintain an active DarbSafi account.

You are responsible for:

Keeping your login credentials confidential.
All activity that occurs under your account.
Keeping your account information reasonably accurate and up to date.
Promptly notifying us of unauthorized access, suspected compromise, or unusual activity.
Protecting access to your device, email account, and authentication method.

You must not share, sell, transfer, rent, or assign your account to another person. You must not use another person’s account without authorization.

We may deny, suspend, or restrict access if information appears inaccurate, incomplete, abusive, fraudulent, unlawful, or inconsistent with these Terms.

5. Service Description

DarbSafi is designed to help drivers and app users personally track work activity and understand estimated net results. Depending on your usage, device permissions, and available features, DarbSafi may support:

Shift tracking and timing.
Trip logging.
Income and expense tracking.
Vehicle-related cost estimation, including fuel, oil, maintenance, and other driving-related costs.
Reports, summaries, targets, planning tools, and insights.
Support tickets, deletion requests, notifications, and account management.

DarbSafi is not a transportation network, booking platform, dispatch service, passenger marketplace, delivery marketplace, taxi company, employer, payroll provider, bank, payment processor, insurance provider, tax advisor, legal advisor, accounting firm, or financial advisor.

DarbSafi is not an emergency service and must not be relied on for emergency communications, dispatch, rescue, urgent response, medical assistance, police assistance, or road safety alerts.

6. DarbSafi Estimates Are Informational

DarbSafi may generate reports, calculations, estimates, summaries, and insights based on information you enter, device signals you allow, and app logic. These outputs are provided for informational and personal tracking purposes only.

DarbSafi reports and estimates may not match official statements, tax records, platform payouts, invoices, accounting records, bank records, employer records, or government records.

You are responsible for reviewing your data, checking calculations, and using appropriate official records before making legal, tax, accounting, employment, operational, or financial decisions.

You should obtain independent professional advice when needed for legal, tax, financial, accounting, insurance, or employment matters.

7. Data Accuracy and User Responsibility

DarbSafi relies on information you provide and device signals you allow. You are responsible for:

Entering accurate shift, trip, income, expense, vehicle, target, and planning data.
Reviewing generated reports before using them for personal, financial, or operational decisions.
Correcting or updating inaccurate data where editing features are available.
Complying with the rules of any ride-hailing, delivery, taxi, courier, employer, or transportation platform you use.
Complying with applicable traffic, labor, tax, accounting, commercial, and data-related laws that apply to you.

Estimated outputs, including net earnings, costs, distance, duration, route information, and analytics, may vary from real-world outcomes.

8. App Permissions and Location-Based Features

Some features require device permissions. DarbSafi may request access to:

Location: to calculate shift distance, route markers, trip-related metrics, map views, and driving-related cost estimates.
Background location: to continue calculating distance and route data during an active shift when the app is not open, if supported and enabled.
Notifications: to send shift reminders, trip or shift alerts, support updates, account messages, and other app-related notifications.
Camera, photos, or files: only if you choose to upload screenshots, receipts, or attachments for support or a feature that requires them.

DarbSafi does not access device permissions unless they are needed for app features and allowed by your device settings. If permissions are denied, disabled, revoked, or limited, some features may be unavailable, less accurate, or degraded.

You can manage permissions through your device settings at any time.

9. Driving Safety

DarbSafi is intended to support drivers with tracking, logging, and analytics. It must not be used in a way that distracts from safe driving or violates applicable road safety and device-use laws.

You are responsible for:

Following all traffic, road safety, and mobile device-use laws.
Using DarbSafi only when it is safe and lawful to do so.
Avoiding interaction with the app while driving if it may cause distraction.
Delaying app interaction until safely stopped and parked where interaction while moving is unsafe or unlawful.
Using mounts, voice features, or hands-free features only where safe, lawful, and appropriate.
Complying with the safety rules and policies of any rideshare, delivery, taxi, courier, employer, or transportation platform you use.

To the maximum extent permitted by applicable law, DarbSafi is not liable for accidents, injuries, traffic violations, fines, penalties, platform disputes, lost earnings, or other losses arising from unsafe, distracted, unlawful, or improper use of the Service. Nothing in this section limits liability that cannot be excluded under applicable law.

10. License to Use the Service

Subject to your compliance with these Terms, DarbSafi grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Service on your compatible personal device for its intended purpose.

This license does not transfer ownership of the Service or any DarbSafi intellectual property to you. Any rights not expressly granted are reserved by DarbSafi and its licensors.

11. Acceptable Use and Restrictions

You must not:

Use DarbSafi for unlawful, fraudulent, abusive, misleading, harmful, or deceptive activity.
Use the Service in a way that violates traffic, safety, employment, tax, privacy, intellectual property, platform, or other applicable laws or third-party rights.
Attempt unauthorized access to DarbSafi systems, accounts, backend services, source code, security controls, or user data.
Interfere with app stability, security, infrastructure, network operations, or service reliability.
Reverse engineer, decompile, disassemble, modify, tamper with, or attempt to derive source code from the Service except where applicable law expressly permits.
Copy, reproduce, modify, sell, resell, lease, sublicense, distribute, publicly display, frame, mirror, scrape, index, or commercially exploit the Service except as expressly permitted by DarbSafi.
Use bots, scripts, crawlers, automation, scraping, data mining, or load-testing tools to abuse, disrupt, or extract data from the Service.
Upload or submit content that is unlawful, defamatory, hateful, threatening, violent, obscene, harmful, infringing, fraudulent, or otherwise inappropriate.
Misrepresent your identity, age, affiliation, platform relationship, earnings, expenses, or account information.
Use DarbSafi to harass, threaten, impersonate, or harm another person.

12. Third-Party Platforms and No Affiliation

DarbSafi may allow you to record income, expenses, notes, or platform names related to third-party work sources, such as ride-hailing, taxi, courier, or delivery platforms. Any platform names you enter are for your personal records only.

DarbSafi is not affiliated with, endorsed by, sponsored by, or officially connected to Uber, Careem, Bolt, Jeeny, or any other ride-hailing, taxi, courier, or delivery platform unless expressly stated.

DarbSafi does not control third-party platforms, their payments, rules, statements, ratings, eligibility decisions, suspensions, incentives, bonuses, fees, taxes, or driver requirements. You are responsible for reviewing and complying with any third-party platform terms, policies, and official records that apply to you.

13. Third-Party Services and Infrastructure

DarbSafi depends on third-party providers for infrastructure and technical delivery, such as authentication, hosting, database services, notifications, maps, routing, email, diagnostics, and security.

Third-party services may be governed by their own terms, policies, availability, security practices, and service limitations. We are not responsible for outages, failures, delays, inaccuracies, map issues, notification failures, data connectivity problems, or other problems caused by third-party providers, your device, your network, your operating system, or external infrastructure.

14. Network Access and Devices

You are responsible for obtaining and maintaining the data network access, internet connection, mobile plan, device, operating system, and compatible hardware necessary to access and use the Service.

Your mobile network’s data, roaming, messaging, and other rates and fees may apply. You are responsible for those charges.

DarbSafi does not guarantee that the Service will function on every device, operating system version, network, region, or configuration. The Service may be subject to malfunctions, delays, location inaccuracies, sync problems, or interruptions inherent in mobile networks, GPS, the internet, cloud services, and electronic communications.

15. Intellectual Property

All rights in the Service, including software, design, text, graphics, icons, trademarks, logos, brand elements, workflows, documentation, and related content, are owned by DarbSafi or its licensors, except for user-provided content.

You may not use DarbSafi’s name, trademarks, logos, trade dress, screenshots, or brand assets in a way that suggests affiliation, endorsement, sponsorship, or official approval without prior written permission.

No ownership rights are transferred to you under these Terms.

16. Your Content and License to Operate

You retain ownership of data and content you submit to DarbSafi, such as profile inputs, vehicle records, shift records, trip records, income entries, expense entries, notes, support messages, attachments, screenshots, and feedback.

You grant DarbSafi a limited license to host, store, process, transmit, display, analyze, and use that content only as needed to:

Operate, maintain, and secure the Service.
Provide requested features and support.
Generate reports, summaries, insights, calculations, and estimates.
Sync data between your device and backend services.
Troubleshoot issues, maintain reliability, and prevent abuse.
Comply with applicable law, lawful requests, and these Terms.

You represent that you have the rights needed to submit any content you provide and that your content does not violate applicable law or third-party rights.

If you submit suggestions, ideas, bug reports, or feedback about DarbSafi, you grant DarbSafi a non-exclusive, worldwide, royalty-free license to use and incorporate that feedback to improve the Service without compensation to you.

17. Privacy and Data Handling

Our Privacy Policy explains how DarbSafi collects, uses, stores, shares, transfers, retains, deletes, and protects personal data.

By using DarbSafi, you acknowledge the Privacy Policy and, where consent is the applicable legal basis, consent to the processing described there.

18. Account Deletion

You can request account deletion directly in the app from:

The current DarbSafi deletion flow is permanent account deletion, not temporary deactivation.

When deletion is requested:

User-linked app records used by current DarbSafi services are deleted from active production systems, except for limited records retained where required or permitted by law, security, or operational needs.
The authentication account is deleted.
A minimal technical deletion audit record may be retained for a limited period for security, troubleshooting, abuse prevention, and operational verification, without storing raw name, raw email, or raw phone number.
Examples of limited retained records may include records needed for security, fraud prevention, dispute handling, legal compliance, or technical verification.
If encrypted backups are enabled in the infrastructure, deletion from backups follows the backup lifecycle timing.
On successful deletion, DarbSafi may provide a deletion reference identifier for operational follow-up.

19. Paid Features, Subscriptions, and Billing

As of the Last Updated date, DarbSafi does not require paid membership or subscription billing to use current core features.

If paid plans, subscriptions, in-app purchases, or premium features are introduced later:

Additional pricing, billing, renewal, cancellation, refund, and tax terms may apply.
Platform billing rules, such as Apple App Store or Google Play rules, may apply where relevant.
Taxes and fees, if applicable, will be disclosed before purchase where required.
Payment processing may be handled by Apple, Google, or another payment provider. DarbSafi will not receive or store your full card details unless the feature clearly requires it and the Privacy Policy is updated accordingly.

Unless required by applicable law or the relevant app store rules, purchases and subscription fees may be non-refundable once charged.

20. Beta Features, Changes, and Availability

DarbSafi may release, test, modify, suspend, or discontinue features at any time. Some features may be experimental, incomplete, region-limited, device-limited, or made available to selected users.

We do not guarantee that any feature will remain available, error-free, or unchanged. Where reasonably required, we may provide notice of material changes.

21. No Warranty

To the maximum extent permitted by applicable law, the Service is provided on an “as is” and “as available” basis, without warranties of any kind, express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant, represent, or guarantee that:

The Service will be uninterrupted, secure, error-free, accurate, complete, or always available.
Location, route, distance, time, income, expense, cost, or net earnings calculations will be complete, accurate, or suitable for your specific use case.
The Service will meet your requirements or produce any particular result.
The Service will match official records, third-party platform statements, tax records, employer records, invoices, or bank records.

Nothing in these Terms limits non-waivable rights under applicable consumer law.

22. Limitation of Liability

To the maximum extent permitted by applicable law:

DarbSafi and its affiliates, officers, employees, contractors, licensors, and agents are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, savings, goodwill, data, business opportunity, or business interruption.
DarbSafi is not liable for losses arising from your use of or reliance on reports, estimates, calculations, summaries, insights, location data, route information, or any other output generated by the Service.
DarbSafi is not liable for accidents, injuries, traffic violations, fines, platform disputes, account suspensions by third-party platforms, lost incentives, lost earnings, tax issues, accounting issues, or employment disputes related to your driving work or use of the Service.
DarbSafi is not liable for outages, delays, data loss, sync issues, notification failures, location inaccuracies, map issues, unauthorized access, or service interruptions caused by third-party providers, networks, devices, operating systems, user error, or events beyond our reasonable control.
Our aggregate liability arising out of or relating to these Terms or the Service will not exceed the greater of: (a) the amount you paid DarbSafi for the Service in the 12 months before the claim, or (b) SAR 200.

This limitation does not apply where liability cannot be excluded or limited by law, including liability for willful misconduct, gross negligence, fraud, or other non-excludable rights under applicable law.

23. Indemnity

You agree to defend, indemnify, and hold harmless DarbSafi and its affiliates, officers, employees, contractors, licensors, and agents from and against claims, losses, liabilities, damages, costs, and expenses, including reasonable legal fees, arising out of or related to:

Your misuse of the Service.
Your breach or alleged breach of these Terms.
Your violation of applicable law or third-party rights.
Your user content, data entries, support messages, attachments, or feedback.
Your driving work, platform relationships, tax obligations, accounting decisions, or employment relationships.
Your unsafe, distracted, unlawful, or improper use of the Service.

24. Suspension and Termination

We may suspend, restrict, or terminate access to the Service, with or without notice, if:

You materially or repeatedly breach these Terms.
Your account or activity appears fraudulent, abusive, unlawful, unsafe, or harmful.
Needed to protect users, DarbSafi systems, security, service reliability, legal compliance, or third-party rights.
Required by law, lawful request, app store rule, infrastructure provider requirement, or security incident response.

You may stop using the Service at any time and may request account deletion through the in-app flow or deletion support page.

Sections that by nature should survive termination remain effective, including sections on intellectual property, user content licenses, privacy, account deletion, disclaimers, liability limits, indemnity, governing law, disputes, and general terms.

25. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Kingdom of Saudi Arabia, unless mandatory law in your jurisdiction requires otherwise.

Before filing a formal claim, both parties agree to attempt good-faith resolution by contacting the other party first and giving the other party a reasonable opportunity to respond.

Subject to mandatory consumer law, disputes arising out of or relating to these Terms or the Service will be submitted to the competent courts of Riyadh, Saudi Arabia.

26. Notices

DarbSafi may provide notices by email, in-app message, website posting, notification, support message, or another reasonable method. You are responsible for keeping your contact information accurate and for checking messages related to your account.

You may contact DarbSafi using the contact details in Section 31.

27. Force Majeure

DarbSafi is not liable for delay or failure caused by events beyond reasonable control, including infrastructure outages, internet failures, mobile network failures, cloud provider incidents, GPS issues, map provider issues, natural disasters, government actions, war, civil unrest, cyberattacks, labor disruptions, utility interruptions, app store restrictions, or legal/regulatory changes.

28. Platform-Specific Terms

Apple App Store

If you downloaded DarbSafi from the Apple App Store:

These Terms are between you and DarbSafi, not Apple.
Apple has no obligation to provide maintenance or support for DarbSafi.
To the maximum extent permitted by applicable law, Apple has no warranty obligation with respect to DarbSafi. If DarbSafi fails to conform to an applicable warranty and you paid a purchase price through Apple, you may notify Apple, and Apple may refund that purchase price, if any, to you.
Apple is not responsible for addressing any claims by you or any third party relating to DarbSafi, including product liability claims, legal or regulatory claims, consumer protection claims, or claims that DarbSafi fails to conform to applicable legal or regulatory requirements.
Apple is not responsible for any third-party intellectual property claims relating to DarbSafi or your possession and use of DarbSafi.
Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

Google Play

If you downloaded DarbSafi from Google Play:

These Terms are between you and DarbSafi, not Google.
Google has no obligation to provide maintenance or support for DarbSafi.
Google is not responsible for addressing any claims by you or any third party relating to DarbSafi.
Google is not responsible for any third-party intellectual property claims relating to DarbSafi or your possession and use of DarbSafi.
You must also comply with Google Play terms that apply to your use of apps and services.

29. Export and Sanctions Compliance

You represent that you are not located in, under the control of, or ordinarily resident in any country or territory subject to comprehensive trade sanctions applicable to your use of the Service, and that you are not listed on any prohibited or restricted party list applicable to such use.

You agree not to use, export, re-export, transfer, or make available the Service in violation of applicable export control, sanctions, or trade compliance laws.

30. General Terms

Severability

If any provision of these Terms is held invalid, illegal, or unenforceable, the remaining provisions continue in full force. The invalid or unenforceable provision will be replaced or interpreted, where possible, to achieve a similar lawful effect.

Waiver

Failure by DarbSafi to enforce any right or provision is not a waiver of that right or provision.

Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign or transfer these Terms in connection with a merger, acquisition, reorganization, sale of assets, change of operator, or by operation of law.

No Agency

No joint venture, partnership, employment, contractor, agency, fiduciary, or franchise relationship exists between you and DarbSafi as a result of these Terms or your use of the Service.

Entire Agreement

These Terms, together with the Privacy Policy and any applicable supplemental terms, are the entire agreement between you and DarbSafi regarding the Service and supersede prior or contemporaneous agreements or understandings regarding the Service.

Interpretation

In these Terms, “including” means “including, but not limited to.” Section headings are for convenience only and do not affect interpretation.

If there is a conflict between versions, the English version governs to the extent permitted by applicable law.
